Taiyuan City Issues Detailed Rules for Implementing Pension Insurance for Land-Expropriated Farmers
Ensure that the living standards of land-expropriated farmers do not decline because of land expropriation, and that their long-term livelihood is guaranteed. On February 2, the reporter learned from the Taiyuan Municipal Government that the "Detailed Rules for the Implementation of Basic Pension Insurance for Land-Expropriated Farmers in Taiyuan City (Trial)" has been approved by the municipal government and issued. From now on, Taiyuan City will follow the principles of pre-expropriation, priority to protection, expenditure based on revenue, and gradual improvement, and will implement basic pension insurance for land-expropriated farmers on the basis of insurance upon expropriation and protection before expropriation.
Land-expropriated farmers refer to people who are at least 16 years old and who hold rural collective land contracting rights at the time when the government uniformly expropriates rural collective land. In principle, the number of land-expropriated farmers participating in insurance shall be calculated by dividing the amount of cultivated land expropriated by the average amount of cultivated land per person held by people at least 16 years old in the expropriated unit before land expropriation. If the expropriated land does not involve cultivated land, the number of land-expropriated farmers participating in insurance may be calculated by dividing the amount of agricultural land expropriated by the average amount of agricultural land per person held by people at least 16 years old in the expropriated unit before land expropriation.
For village (neighborhood) committees where the per capita agricultural land after land expropriation is less than 0.4 mu (including 0.4 mu), upon approval by the municipal or county (city) people's government, all village (neighborhood) residents may participate in insurance as a whole according to the regulations.
The age determination of land-expropriated farmers participating in insurance shall be based on the date of implementation of the "Land Expropriation Compensation and Resettlement Plan" approved by the municipal government or the whole-village (neighborhood) insurance participation plan approved by the municipal or county (city) government. The specific insured persons shall be determined by the village (neighborhood) committee.
The following persons are not included in the scope of basic pension insurance for land-expropriated farmers: those who have obtained adjusted land again; those for whom the government has made appropriate arrangements and who have participated in the basic pension insurance for urban enterprise employees; those who have received land compensation fees and resettlement subsidies and whose household registration has been moved elsewhere or who have settled abroad (outside the country); those whose household registration is still in the land-expropriated village (neighborhood) but who, before land expropriation, already enjoyed basic pension insurance benefits for urban enterprise employees or who retired (left office) from government agencies and public institutions; and persons within the protection scope during the period of serving a sentence.
The basic pension insurance premiums for land-expropriated farmers shall be jointly borne by the farmers themselves, rural collective economic organizations, and the municipal and county (city) governments and development zone management committees. For the basic pension insurance premiums of land-expropriated farmers not included in whole-village (neighborhood) insurance participation, the pension insurance premiums borne by the farmers themselves and the rural collective economic organizations shall be arranged uniformly from the resettlement subsidies increased according to regulations and the land compensation fees used for land-expropriated farmer households. If these two items of expenses still do not reach the minimum contribution standard for individual contributions and village collective subsidies in the locality where the land is located, the difference shall be resolved by the municipal and county (city) governments and development zone management committees from the revenue from the transfer of state-owned land.
The pension insurance premiums paid by individual land-expropriated farmers and rural collective economic organizations shall be subject to a pre-deposit system. The municipal finance department shall establish a special account for pre-deposited pension insurance for land-expropriated farmers. When land-expropriated farmers reach the age for receiving pension benefits, they shall enjoy pension benefits according to the protection standard selected at the time of contribution.
The municipal government requires county (city, district) governments and development zone management committees to organize relevant departments and units to conscientiously implement the "Land Expropriation Compensation and Resettlement Plan" and do a good job in the insurance participation work of land-expropriated farmers.
