Shandong Bambo Chemical's Fake Pesticide "Shaweibang" Accused of Being Inferior Pesticide; Arrests Approved in Major Counterfeit Pesticide Case
Three subsidiaries of a company planning to go public sold inferior pesticides they produced to 22 provinces including Zhejiang, Shanghai and Shandong. The amount involved in the case confirmed so far exceeds 19 million yuan. Recently, the Xianju County Procuratorate of Zhejiang Province approved the arrest of 15 criminal suspects, including the company's legal representative Ouyang Chunsheng, on suspicion of the crime of producing and selling inferior products.
In January this year, when prosecutors from the investigation supervision department of the Xianju County Procuratorate were in regular contact with the county's Agricultural Bureau, they discovered that a case of inferior pesticides sold in Xianju by a certain company in Pan'an, Zhejiang, which had been uncovered by the agricultural department, might involve a crime. The procuratorate therefore kept close watch, promptly followed the progress of the case, and, under the “linkage between the two laws” working mechanism, actively intervened in advance, held consultations with the county Agricultural Bureau, and guided evidence collection. After the relevant circumstances of the case and some of those responsible were preliminarily identified, the county Agricultural Bureau transferred the criminal leads to the public security organ.
After filing the case for investigation, the Xianju County Public Security Bureau found that the inferior pesticides sold by the company in Pan'an were developed and produced by three subsidiaries of an enterprise in Jiangxi, and therefore also filed a case for investigation against the enterprise involved and the relevant personnel. The Xianju County Procuratorate carried out simultaneous follow-up supervision, kept timely track of the investigation and evidence collection, held consultations many times, offered opinions on investigation, evidence collection and the characterization of the case, and actively guided the investigation and evidence collection work.
Although a criminal case had already been filed against the enterprise involved and the relevant parties, the inferior pesticides produced by the enterprise were still circulating on the market, seriously threatening the safety of people's lives and property. In April, during the spring plowing season, while following up and supervising the investigation activities of the public security organ, the procuratorate issued procuratorial recommendations in accordance with the law to the county Public Security Bureau and the Agricultural Bureau respectively, suggesting that joint measures be taken with the public security organs and agricultural departments in the places of sale to recover the pesticides involved. The county Public Security Bureau and Agricultural Bureau acted quickly and jointly made every effort to recover and retrieve the pesticides involved within Xianju County. The county Public Security Bureau sealed up and seized more than 150 tons of inferior pesticides in the warehouse of the enterprise involved in accordance with the law, and notified public security organs in various places of the relevant information through the Ministry of Public Security so as to facilitate sealing and recovery. The county Agricultural Bureau also blocked the circulation of the inferior pesticides through higher-level agricultural departments.
At the same time, during the review of arrests, the procuratorate found that the company's legal representative Ouyang Chunsheng, in pursuit of economic interests, had instructed relevant employees of the company to develop, produce and sell inferior pesticides. His actions were suspected of the crime of producing and selling inferior products, but the public security organ had not filed a case. The procuratorate therefore initiated case-filing supervision in accordance with the law. In May this year, the public security organ filed a case for investigation against Ouyang Chunsheng. On June 28, Ouyang Chunsheng's arrest was approved by the procuratorate. To date, since April this year, the procuratorate has approved the arrest of 15 criminal suspects in this major inferior pesticide case in accordance with the law.
