Ministry of Agriculture Reports Two Typical Cases of Producing and Selling Fake and Inferior Veterinary Drugs
Recently, the Ministry of Agriculture reported cases of suspected production and sale of fake and inferior veterinary drugs by Qingdao Nuodi Pharmaceutical Co., Ltd. (hereinafter referred to as Qingdao Nuodi) and Jiangxi Hailian Animal Pharmaceutical Co., Ltd. (hereinafter referred to as Jiangxi Hailian), among which the Jiangxi Hailian case was the first case in the country of adding clenbuterol to veterinary drugs, and the main criminal suspect was sentenced to life imprisonment in the first instance. In recent years, agricultural departments and public security departments have continuously improved and perfected the inter-departmental cooperation working mechanism, strengthened cooperative case handling, and jointly cracked down on illegal and non-compliant acts involving veterinary drugs, achieving good results.
Qingdao Nuodi suspected case of producing fake and inferior veterinary drugs. In October 2012, based on a report, the Shandong Provincial Public Security Department and the Shandong Provincial Animal Husbandry and Veterinary Bureau, together with the Qingdao Municipal Public Security Bureau, conducted a surprise inspection of Qingdao Nuodi, seizing at the scene a counterfeit production line, suspected inferior veterinary drug raw materials, finished products and semi-finished products, suspected counterfeit registered trademark labels, drug labels, and other items. Upon determination, 79 types of veterinary drugs produced by Qingdao Nuodi, including strong-effect diquanet, were all fake veterinary drugs, and the amprolium sulfate produced was non-compliant veterinary drugs, with the above veterinary drugs produced and sold having a total value of more than 1.5 million yuan. Upon trial by the court of first instance, it was held that the defendant unit Qingdao Nuodi and 8 defendants including Wang Moumou all constituted the crime of producing and selling inferior products.
⟦NL> Jiangxi Hailian suspected case of producing and selling fake and inferior veterinary drugs. In April 2013, on the basis of preliminary work by the agricultural department of Zhejiang Province, upon lawful investigation by the public security organ, 7 products produced and sold by Jiangxi Hailian, including Feihu Xiongyan Kang, were found to have illegally added clenproperol hydrochloride, 2 products including Xin Niuyang Jinzun were found to have illegally added ribavirin, 4 products including Zhongzheng Juesha had no veterinary drug product approval numbers, and 20 products including Yinhuang Baidu Interferon had unauthorized changes to product formulations with added other ingredients, with the amount involved reaching more than 10 million yuan. Upon trial by the court of first instance, it was held that all 5 defendants committed the crime of producing and selling inferior products.
In the face of the current situation of veterinary drug quality and safety, the Ministry of Agriculture reiterated that veterinary drug regulatory authorities at all levels should further intensify veterinary drug supervision, take the opportunity of implementing the announcement on heavier penalties for illegal veterinary drug acts (Ministry of Agriculture Announcement No. 2071) to carry out in-depth rectification of the veterinary drug market, strengthen veterinary drug supervision and law enforcement, insist on striking as soon as problems emerge, and always maintain a high-pressure posture. Strengthen supervision and random inspection, implement “inspection and enforcement linkage”, achieve “inspection in one place, investigation and handling nationwide”, strictly crack down on illegal additions, counterfeit production and sale, and other illegal acts, cut off illegal interest chains, and leave fake and inferior veterinary drugs nowhere to hide. Continue to strengthen the connection between administrative law enforcement and criminal justice, strictly implement the “two supremes” judicial interpretations, actively cooperate with public security and other relevant departments, concentrate on investigating and handling a number of major and important cases, shut down a number of “black dens”, close a number of seriously illegal enterprises, severely punish a number of law-breaking criminals, publish a number of typical cases, fully give play to the deterrent role of justice, promote the healthy development of the veterinary drug industry, and effectively safeguard the safety of the breeding industry, public health safety, and food safety.
