Fertilizers and pesticides are both needed in agricultural production, used for fertilizing and for preventing, eliminating or controlling diseases, insects, weeds and other harmful organisms that harm agriculture and forestry. So how can we buy high-quality pesticides and fertilizers? What should we do if we buy fakes?

How can we buy high-quality pesticides and fertilizers? What should we do if we buy fakes?

When buying pesticides, you should:

1. Product outer packaging. For any qualified commercial pesticide, the label and instructions indicate the pesticide name, active ingredient content, registered trademark, batch number, production date, shelf life, and the three certificate numbers——the pesticide registration certificate number, approval certificate number, and product standard number, and are accompanied by product instructions and a certificate of conformity.

2. Product appearance. If powders, wettable powders, or soluble powders are caked; if liquid formulations are cloudy; if emulsifiable concentrates are not transparent; or if granules contain too much powder, it is best not to buy them.

When buying compound fertilizers, you should:

1. Check the fertilizer seller's business qualifications and whether they have a business license for dealing in fertilizers and other lawful procedures.

2. Check the product certificate of conformity and the fertilizer inspection report, and ask for a purchase and sales receipt (to be used in case of fertilizer quality disputes).

3. Check the fertilizer labeling, clearly distinguish the fertilizer category and nature, and understand the fertilizer's nutrient content, use, method of application, and precautions.

4. Check whether the fertilizer enterprise has handled the relevant procedures. Compound fertilizers require a production license, a provincial-level fertilizer registration certificate, and so on.

What should you do if you buy fake pesticides or fertilizers?

When buying pesticides and fertilizers, you should pay attention to the following points:

1. When buying agricultural materials such as fertilizers and pesticides, you must go to regular business outlets; the seller must have a business license, a business permit, and the practitioners must have qualification certificates.

2. Carefully identify whether the product you are buying comes from a regular manufacturer; the packaging should indicate the product name, production license, quality execution standard, production address, ingredient content, shelf life, usage instructions, and so on.

3. After purchasing, ask for an invoice on the spot; the invoice should be stamped, and you should keep it properly. If you find quality problems, report them promptly to the industry and commerce department.

For the sale of counterfeit and inferior agricultural materials, relevant law enforcement departments may investigate and punish according to the Trademark Law, the Law on the Protection of Consumer Rights and Interests, the Product Quality Law and other relevant laws, and if the circumstances are serious, criminal liability shall be pursued according to law. Article 147 of the Criminal Law specifically provides for penalties for the crime of producing and selling inferior seeds, pesticides and fertilizers. Whoever produces fake pesticides, fake veterinary drugs, or fake fertilizers, or sells pesticides, veterinary drugs, fertilizers, or seeds that they clearly know to be fake or to have lost their efficacy, or producers or sellers pass off substandard pesticides, veterinary drugs, fertilizers, or seeds as qualified pesticides, veterinary drugs, fertilizers, or seeds, thereby causing relatively large losses to production, shall be sentenced to fixed-term imprisonment of not more than 3 years or criminal detention, and shall also or only be fined not less than 50% and not more than 2 times the sales amount; if relatively large losses are caused to production, the sentence shall be fixed-term imprisonment of not less than 3 years and not more than 7 years, and a fine of not less than 50% and not more than 2 times the sales amount; if especially large losses are caused to production, the sentence shall be fixed-term imprisonment of not less than 7 years or life imprisonment, and a fine of not less than 50% and not more than 2 times the sales amount or confiscation of property. On April 9, 2001, the Supreme People's Court and the Supreme People's Procuratorate jointly issued the Interpretation on Several Issues Concerning the Specific Application of Law in Handling Criminal Cases of Producing and Selling Inferior Commodities, in which Article 7 clarifies that in the crime of producing and selling inferior pesticides, veterinary drugs, fertilizers, and seeds as provided in Article 147 of the Criminal Law, “causing relatively large losses to production” generally starts at 20,000 yuan; “major losses” generally start at 100,000 yuan; and “especially major losses” generally start at 500,000 yuan. In addition, the judicial interpretation also provides for the general circumstances of the crime of producing and selling inferior commodities, which of course also applies to the crime of producing and selling inferior seeds, pesticides, and fertilizers. For example: whoever knows or should know that another person is committing the crime of producing or selling inferior commodities (including seeds, pesticides, and fertilizers) and provides loans, funds, accounts, invoices, certificates, or license documents, or provides production or business premises or conveniences such as transportation, storage, safekeeping, or mailing, or provides production techniques for making counterfeits, shall be punished as an accomplice in the crime of producing and selling inferior commodities. If the crime of producing and selling inferior commodities also constitutes other crimes such as infringement of intellectual property rights or illegal business operations, conviction and punishment shall be determined according to the provisions providing the heavier penalty. If a criminal who produces and sells inferior commodities resists investigation by violent or threatening means and this constitutes another crime, punishment shall be determined according to the provisions on combined punishment for several crimes. State organ functionaries who participate in the crime of producing and selling inferior commodities shall be given a heavier punishment.
